The short version: Use AES responsibly. Only send emails to people who expect to hear from you. Don't spam. You're responsible for how you use it. We can suspend accounts that violate these terms.
1. Acceptance of terms
By installing AES, creating an account, or otherwise accessing or using Automatic Email Scheduler ("AES", "Service", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use AES.
We reserve the right to update these Terms at any time. Continued use of AES after changes are posted constitutes your acceptance of the updated Terms.
2. Description of service
AES is a Microsoft Outlook add-in that allows users to manage client contacts, create email templates, and schedule automated email campaigns. Emails are sent via the Microsoft Graph API using the user's own Microsoft account credentials. AES does not operate as a bulk email or mass mailing service.
3. Eligibility
You must be at least 18 years old and capable of forming a legally binding contract to use AES. AES is intended for business use by professionals, not for personal or consumer-facing marketing campaigns.
4. Account and security
You are responsible for maintaining the security of your Microsoft account credentials. AES accesses your Microsoft account via OAuth 2.0 — your password is never shared with or stored by AES. You may revoke AES's access at any time via your Microsoft account settings.
You are responsible for all activity that occurs through your AES account. Notify us immediately at AEscheduler@outlook.com if you suspect unauthorized access.
5. Acceptable use
You agree to use AES only for lawful purposes and in accordance with these Terms. You must not use AES to:
- Send unsolicited bulk email ("spam") to recipients who have not consented to receive communications from you
- Violate any applicable law or regulation, including CAN-SPAM, GDPR, CASL, or other anti-spam legislation
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Send emails containing malware, phishing content, or links to harmful websites
- Harass, threaten, or harm any individual or organization
- Attempt to gain unauthorized access to AES's systems or infrastructure
- Use AES in a way that could damage, disable, or impair the Service or Microsoft's services
- Resell, sublicense, or otherwise commercialize access to AES without our written permission
Email consent responsibility
You are solely responsible for ensuring you have the legal right to contact every recipient you add to AES. This includes having appropriate consent under applicable anti-spam and data protection laws. AES is a tool — it does not verify consent on your behalf.
6. Free and Pro plans
AES is available on a free tier with the following limits: up to 50 clients, up to 3 groups, and up to 2 campaigns. Templates are unlimited on all plans.
The AES Pro plan is available for $10/month (or as otherwise stated on the pricing page at the time of purchase) and includes unlimited clients, groups, and campaigns. Pricing is subject to change with reasonable notice.
All billing is handled by Stripe. By subscribing to AES Pro, you agree to Stripe's terms of service. Subscriptions renew automatically each month. You may cancel at any time via your billing portal — cancellation takes effect at the end of the current billing period.
Refunds are available within 7 days of the initial purchase if you have not sent any campaign emails during that period. Contact us at AEscheduler@outlook.com to request a refund.
7. Microsoft account and Graph API
AES requires a Microsoft 365 or Outlook account. Your use of AES is also subject to Microsoft's terms of service and privacy policy. AES uses the Microsoft Graph API to send emails and access your Drafts folder (when you use the "Import from Drafts" feature). We request only the permissions necessary to operate the Service: Mail.Read, Mail.ReadWrite, Mail.Send, and User.Read.
8. Data and privacy
Your use of AES is also governed by our Privacy Policy, which is incorporated into these Terms. By using AES, you agree to our collection and use of data as described in the Privacy Policy.
9. Intellectual property
AES and all its components (software, design, content) are owned by us and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use AES for its intended purpose. You may not copy, modify, distribute, or create derivative works of AES without our written consent.
You retain ownership of all content you create in AES — your client roster, templates, and campaign data are yours.
10. Disclaimers and limitation of liability
AES is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that AES will be error-free, uninterrupted, or that emails will be delivered on time or at all (delivery depends on Microsoft's infrastructure and the recipient's email provider).
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of AES, including but not limited to lost profits, lost data, or reputational damage, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of AES shall not exceed the total amount you paid us in the 3 months prior to the claim.
11. Indemnification
You agree to indemnify and hold harmless AES, its owners, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of AES; (b) your violation of these Terms; (c) your violation of any applicable law; or (d) any emails you send using AES.
12. Suspension and termination
We reserve the right to suspend or terminate your account at any time, with or without notice, if we determine in our sole discretion that you have violated these Terms, engaged in abusive or spammy behavior, or pose a risk to AES's infrastructure or other users.
You may terminate your account at any time by contacting us at AEscheduler@outlook.com. Upon termination, your data will be retained for 30 days before deletion, unless you request immediate deletion.
13. Governing law
These Terms are governed by the laws of the State of New York, United States, without regard to its conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in New York County, New York.
